terms and conditions

For the purpose of these Terms and Conditions, the "Advertiser" shall be defined as the party purchasing advertising services from Dashofer Holding Ltd ("Dashofer"). The "Advertisement" shall be defined as the graphical medium provided by the Advertiser or the textual description agreed between the Advertiser and Dashofer, which is designed to promote products, services or visits to the Advertiser's Web Site.

Dashofer shall sell and the Advertiser shall purchase advertising services in accordance with the published terms of Dashofer and these conditions shall govern the Contract to the exclusion of any other terms and conditions specified by the Advertiser. Any variation or waiver of these Terms and Conditions can only be by written agreement of both parties. Upon placing an order with Dashofer, the Advertiser agrees that Dashofer has the right to display, transmit and promote the Advertisement provided by the Advertiser on Jobs.com.cy and Visitors to Jobs.com.cy shall have the right to access any material or services linked to the Advertisement. Any typographical clerical or other error or omission in any Web document, sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by Dashofer shall be subject to correction without any liability on the part of Dashofer. Where advertising is purchased on a period basis, advertisements will be displayed until the period ends.

Right to refuse or remove advertising

Dashofer at its sole discretion, reserves the right to reject an Advertisement or cease to display it if it is deemed to be offensive, in violation of advertising standards or in breach of any Warranties provided by the Advertiser under this Contract. In those circumstances Dashofer reserves the right to terminate this Contract notwithstanding that any Warranties provided hereunder by the Advertiser relating to the transmission and promotion of the Advertisement shall stay in force. Advertising which relates to Adult Content will not be accepted. Any Keyword or Key Phrase Advertisement shall not be accepted if it contains nudity, profane language or is otherwise deemed by Dashofer to be offensive.

Payment by the Advertiser shall be due within the payment period defined in Dashofer's quotation or subsequent acknowledgement of order. If no payment period is set out in these documents, payment shall be due immediately unless the Advertiser has opened a Credit Account with Dashofer, in which case payment shall be made within 30 days of the invoice date. The time of payment of the agreed price shall be of the essence of the Contract. The Advertiser must deliver a signed contract or acknowledgement order three days before the Advertisement start date. Advertisement reservations will not be held without a signed contract. Dashofer will make no refund if the Advertiser requests that the Advertisement be removed prior to the end of the agreed Advertisement period.

Dashofer shall not be liable to the Advertiser by reason of any representation or any implied warranty, condition or other term, or any duty at common law or under the express terms of the contract, for any consequential loss or damage (whether for loss of profit or otherwise) costs expenses or other claims for consequential compensation whatsoever and whether caused by the negligence of Dashofer, its employees or agents or otherwise which arise out of or in connection with the supply of Advertising Services or their use or resale by the Client, except as expressly provided in these conditions. By placing an order for Advertising Services with Dashofer, the Advertiser warrants that: The Advertiser is wholly responsible for any legal liability relating to the Advertisement or the Web content that it links to and the consequences of its transmission or promotion by Dashofer. The Advertisement does not contain or link to any offensive or pornographic content. The transmission or the distribution of the Advertisement and the content which it links to does not infringe any copyright, trademark, intellectual property right or violate the privacy of any individual or breach advertising standards or violate any Laws in any Country or Jurisdiction where the Advertisement can be accessed. The Advertiser further indemnifies Dashofer against any claims, loss, damages, or legal expenses or other expenses in connection with any claims arising from a breach of these warranties.

Any question relating to any quotation or any contract subject to these conditions or agreed amendment of these conditions shall be determined in all respects by the laws of the Republic of Cyprus and the parties agreed to submit to the non-exclusive jurisdiction of the Cyprus Courts.
